AGPL3.0 라이선스가 적용되는 소프트웨어를 저희 회사에서 설치하여 네트워크상으로만 서비스을 할 수 있도록 사용하고자 합니다.

1. 라이선스가 적용되는 소프트웨어에 대해

아무런 수정없이 사용하여

네트워크를 통하여 서비스 할 경우에는 agpl의 제13조에 따라 소스코드 공개 의무가 없는지요?(예전에 아무런 수정이 없어도 배포 혹은 네트워크 서비스 시 소스코드를 공개해야 한다는 회신을 받았는데 혹시 그러하다면 그러한 해석의 근거가 되는 규정을 알 수 있을지요?)

2. 해당 소프트웨어를 kubernetes에서 POD로 실행할 예정인데 만약 소스코드 공개의무가 있다면 어느 범위까지 공개를 해야 하는 것인지요?

1. '제13조 원격 네트워크 통신'의 문구를 보면 수정 시 수정 버전은 소스코드를 제공하도록 해석할 수 있습니다.

제13조는 GPL-3.0에 원격 네트워크 통신에 대한 추가 의무사항으로 원격 네트워크 통신이 아닌 소스코드 혹은 바이너리 배포 시에는 소스코드 공개의무가 발생할 수 있다고 볼 수 있습니다.

즉, 수정하지 않을 경우 원격 네트워크 통신 시에는 소스코드 공개의무가 없을 수 있지만, 소스코드 혹은 바이너리 배포 시에는 수정과 관계없이 AGPL-3.0 범위의 소스코드 공개의무가 발생할 수 있습니다.

13. Remote Network Interaction; Use with the GNU General Public License.

소스코드 혹은 바이너리 배포 시에는 수정 여부와 상관없이 결합 형태에 따라 POD 혹은 컨테이너 범위의 소스코드 공개의무가 발생할 수 있습니다.
